Abstract

This paper seeks to address the current situation regarding the possibilities of public servants regarding syndication, collective negotiation and paralyzation / strike; as it is publicly known, they are expressly prohibited by national law from engaging in such conduct, although in practice they actually do. This context has created, to this day, serious damage to the citizenry, even more so if the State is the only provider of paralyzed services. According to what has been said, it would seem very necessary to innovate, in constitutional and legal terms, on this matter, recognizing public servants, and regulating the right to a special collective negotiation, meeting the singularities of the functions they perform.
